Federal Court Orders Freedom of Kilmar Abrego Garcia from ICE Custody

A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without legal authority.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.

The situation originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an mistake. Following his return to the United States to answer alien smuggling allegations, he was detained in immigration detention.

In her order, the judge pointed out that the authorities does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

Context of the Case

The legal challenge center on disputed assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.

He has also pleaded not guilty to the conspiracy counts, which are part of a ongoing criminal case in the state of Tennessee.
